By accessing our website, submitting a freight inquiry, or engaging our transportation services, you agree to be bound by these Terms in their entirety. If you do not agree to these Terms, please do not use our website or services.
1. Acceptance of Terms
Your access to and use of the website located at this domain constitutes your acceptance of these Terms and Conditions. These Terms apply to all visitors, users, freight clients, and commercial partners who access or use our website or services. The Incline Effect Logistics LLC reserves the right to modify these Terms at any time without prior notice. Continued use of our services following any modification constitutes acceptance of the revised Terms.
These Terms constitute a legally binding agreement between you and The Incline Effect Logistics LLC. If you are accessing or using our services on behalf of a business entity, you represent and warrant that you have the authority to bind that entity to these Terms.
2. Transportation Service Disclaimer
The Incline Effect Logistics LLC provides general freight trucking and logistics coordination services as an interstate carrier authorized under the U.S. Department of Transportation (USDOT). All transportation services are subject to applicable federal and state carrier regulations, including but not limited to Federal Motor Carrier Safety Administration (FMCSA) rules and Georgia Department of Transportation requirements.
Information provided on our website regarding service areas, delivery timelines, and freight capabilities is provided for general informational purposes only and does not constitute a binding service guarantee. Actual service availability, routing, and scheduling are subject to operational conditions, carrier capacity, and regulatory compliance requirements at the time of service engagement.
3. Freight Scheduling
All freight scheduling is subject to carrier availability, route capacity, and operational conditions at the time of booking. Submission of a freight inquiry form does not constitute a confirmed service agreement. A freight service is considered confirmed only upon written or electronic confirmation from The Incline Effect Logistics LLC dispatch team, including confirmation of pickup date, delivery window, and agreed freight terms.
The Company reserves the right to decline, reschedule, or modify any freight assignment based on operational capacity, cargo compliance issues, route availability, or safety considerations. In the event of a scheduling modification, we will provide reasonable advance notice to the client whenever possible.
4. Customer Responsibilities
Clients engaging freight services with The Incline Effect Logistics LLC are responsible for the following:
- Providing accurate and complete cargo descriptions, including weight, dimensions, and freight classification
- Ensuring cargo is properly packaged, labeled, and prepared for transport prior to pickup
- Providing accurate pickup and delivery location information, including access instructions
- Ensuring an authorized representative is available at pickup and delivery locations during scheduled windows
- Disclosing any hazardous materials, restricted cargo, or special handling requirements prior to booking
- Complying with all applicable federal, state, and local regulations regarding the shipment of their cargo
- Providing accurate billing and payment information for service invoices
5. Cargo Limitations
The Incline Effect Logistics LLC does not accept the following cargo types without prior written authorization and applicable permits:
- Hazardous materials requiring HAZMAT placarding beyond our current carrier authorization
- Live animals or perishable biological materials without specialized transport agreements
- Illegal substances, contraband, or items prohibited under federal or Georgia state law
- Cargo exceeding applicable weight and dimension limits without proper oversize/overweight permits
- High-value cargo (exceeding $50,000 declared value) without prior written agreement and appropriate insurance coverage
- Firearms, ammunition, or explosive materials without appropriate federal licensing and documentation
Clients who misrepresent cargo type or specifications are solely responsible for any resulting fines, penalties, delays, or damages incurred by the Company or third parties.
6. Liability Limitations
THE INCLINE EFFECT LOGISTICS LLC'S LIABILITY FOR CARGO LOSS, DAMAGE, OR DELAY IS LIMITED TO THE ACTUAL DECLARED VALUE OF THE FREIGHT AT THE TIME OF SHIPMENT, NOT TO EXCEED THE MAXIMUM LIABILITY ESTABLISHED UNDER APPLICABLE FEDERAL CARRIER LAW (49 U.S.C. § 14706 — THE CARMACK AMENDMENT) UNLESS A HIGHER DECLARED VALUE HAS BEEN AGREED UPON IN WRITING PRIOR TO TRANSPORT.
The Company shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from freight delays, cargo damage, or service interruptions, including but not limited to lost profits, lost revenue, or business opportunity losses. The Company's total liability to any client for any claim arising from a single freight shipment shall not exceed the freight charges paid for that specific shipment.
The Company is not liable for cargo loss or damage resulting from: acts of God or natural disasters; civil unrest, strikes, or government actions; improper packaging by the shipper; inherent vice or nature of the goods; or delays caused by traffic, weather, or road conditions beyond our reasonable control.
7. Dispatch Availability
Dispatch services are available Monday through Friday, 7:00 AM to 6:00 PM Eastern Standard Time. Saturday dispatch is available by appointment only. The Company does not guarantee same-day dispatch response outside of standard business hours. Emergency or after-hours freight inquiries may be submitted via email to services@effectlogistic.com and will be addressed on the next available business day.
8. Service Interruptions
The Incline Effect Logistics LLC reserves the right to suspend, modify, or discontinue any service offering at any time due to operational, regulatory, safety, or business reasons. In the event of a service interruption affecting a confirmed freight booking, we will make reasonable efforts to notify affected clients and arrange alternative solutions where possible.
The Company is not liable for service interruptions caused by circumstances beyond our reasonable control, including but not limited to severe weather events, natural disasters, government orders, road closures, fuel supply disruptions, or equipment failures requiring safety-mandated downtime.
9. Payment Terms
Payment terms for freight services are established in the individual service agreement or freight contract between The Incline Effect Logistics LLC and the client. Unless otherwise agreed in writing:
- Local freight services are invoiced upon completion of delivery
- Regional and interstate freight may require a deposit of up to 50% of the estimated freight charge prior to dispatch
- Commercial freight contracts are subject to net-30 payment terms unless otherwise negotiated
- Invoices unpaid after 30 days are subject to a late fee of 1.5% per month on the outstanding balance
- All fees are denominated in United States Dollars (USD)
The Company reserves the right to withhold freight documentation, including proof of delivery, until full payment has been received for completed services.
10. Intellectual Property
All content on the The Incline Effect Logistics LLC website, including but not limited to text, graphics, logos, images, service descriptions, and design elements, is the proprietary property of The Incline Effect Logistics LLC or its content licensors and is protected by applicable U.S. copyright, trademark, and intellectual property laws. Unauthorized reproduction, distribution, modification, or commercial use of any website content is strictly prohibited without prior written consent from the Company.
11. Website Usage
You agree to use our website only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use of the website. You are prohibited from using our website to transmit unsolicited commercial communications, attempt to gain unauthorized access to our systems, distribute malware or harmful code, scrape or harvest data without authorization, or engage in any activity that disrupts or interferes with the normal operation of the website.
12. Prohibited Activities

13. Indemnification
You agree to indemnify, defend, and hold harmless The Incline Effect Logistics LLC, its members, officers, employees, agents, and contractors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: your use of our website or services; your breach of these Terms; your violation of any applicable law or regulation; any misrepresentation of cargo specifications or freight requirements; or any negligent or wrongful act or omission on your part in connection with our services.
14. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law principles. Any disputes arising under or related to these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Fulton County, Georgia. You consent to personal jurisdiction in such courts and waive any objection to venue or jurisdiction.
To the extent applicable, federal transportation law, including the Carmack Amendment (49 U.S.C. § 14706) and applicable FMCSA regulations, shall govern claims related to cargo loss, damage, or delay.
15. Dispute Resolution
Before initiating any legal proceeding, you agree to first contact The Incline Effect Logistics LLC at services@effectlogistic.com to attempt to resolve any dispute informally. We will make reasonable good-faith efforts to resolve disputes within thirty (30) days of notification. If informal resolution is unsuccessful, disputes shall be resolved through binding arbitration in Fulton County, Georgia, under the rules of the American Arbitration Association, unless either party elects to pursue claims in small claims court.
16. Changes to Terms
The Incline Effect Logistics LLC reserves the right to revise these Terms and Conditions at any time. Revised Terms will be posted on this page with an updated effective date. Your continued use of our website or services after the posting of revised Terms constitutes your acceptance of those changes. We encourage you to review these Terms periodically. If you do not agree to the revised Terms, you must discontinue use of our website and services.
17. Severability
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect.
